GENERAL TERMS AND HIRE AGREEMENT – BOAT (NO LICENCE REQUIRED)

On the one hand, Creuers Costa Nord S.L., Tax ID B-16506529, with registered address at Calle del Roser nº 14 (07760 Ciutadella de Menorca), hereinafter the LESSOR, and on the other hand, the person whose details appear on the attached booking form and who signs this document, hereinafter the HIRER. Both parties acknowledge they have the legal capacity to enter into this agreement and freely agree the following:

  • The LESSOR is the legal owner of the no-licence boats offered for hire and all related equipment.
  • The parties formalise this agreement, governed by the clauses set out below.

1 – Subject of the agreement

The LESSOR agrees to provide the boat for hire and the HIRER agrees to take the boat on hire, both acting in good faith.

2 – Accuracy of information

Any false statement or concealment of relevant information by the HIRER may result in immediate cancellation of the agreement, with any amounts paid being forfeited.

3 – Booking confirmation

The booking will be confirmed once the relevant payment has been received, provided it is made before the date and time indicated in the booking.

4 – Payment, security deposit and payment methods

Before the boat is handed over, the LESSOR must have received the full hire price and a €150 security deposit.

  • The deposit may be paid in cash, or by pre-authorisation/hold on a credit or debit card.
  • The deposit will be refunded (or the hold released) after the hire ends and the boat has been checked, provided there is no damage, loss, fines or outstanding amounts.

5 – Cancellations and changes

  • The customer may cancel up to 24 hours before the booked time for a full refund via the same payment method, or request a date change (subject to availability).
  • Cancellations made less than 24 hours before the start time will incur a 100% charge.
  • The company reserves the right to cancel or amend the booking due to weather or safety reasons. In such cases, an alternative date or refund will be offered as appropriate.

6 – Handover, condition and substitution

The LESSOR undertakes to deliver the boat in perfect working order at the agreed place, date and time. In the event of force majeure (including breakdown) preventing delivery, the LESSOR will inform the HIRER as soon as possible and will try to provide an equivalent boat. If this is not possible, all paid amounts will be refunded, and no further compensation will be due.

7 – Inventory and insurance information

At handover, the HIRER will receive an inventory of the equipment provided for confirmation. Basic information regarding the boat’s insurance policy will also be provided.

8 – Proper use

The HIRER agrees to use and care for the boat and its accessories in accordance with good seamanship, and to take all reasonable measures to prevent loss, accidents or damage. Use under the influence of alcohol, drugs or any substance that may impair ability is strictly prohibited.

9 – Breakdowns, incidents and assistance

In the event of a breakdown or incident, the HIRER must contact the LESSOR as soon as possible and follow the instructions given. If the issue is not due to misuse and cannot be resolved within a reasonable time, the LESSOR will refund the proportional part of the hire not enjoyed, with no entitlement to further claims.

10 – Insurance

The boat is covered by insurance for accidents and public liability, subject to the limitations stated in the policy.

11 – Liability in the event of a claim

If an incident occurs and the insurer does not cover all or part of the damage, costs or liability for any reason, the HIRER shall be responsible for such amounts and expressly releases the LESSOR from liability.

12 – Punctual return

Late return will incur a penalty of €50 per 15 minutes. The boat must be returned to the agreed location. Returning the boat to a different place will result in the HIRER being charged for any related costs and damages.

13 – Children on board

If children will be on board, the HIRER must inform the LESSOR in advance so that appropriate life jackets can be provided.

14 – Inspection and closing

At the agreed return time, passengers and belongings must be off the boat and the boat ready for inspection. Both parties will sign the inspection document. In the event of discrepancies, the LESSOR may retain the deposit until the matter is resolved.

It is strictly forbidden to carry weapons, narcotics, contraband, goods, paying passengers or animals, or to take part in races, commercial fishing or any activity prohibited by current legislation.
