Alquiler de kayaks

The company Creuers Costa Nord S.L. with CIF (“TIN nr.”) B-16506529 and with fiscal address at Calle del Roser nr. 14 (07760 Ciutadella de Menorca), and the person whose particulars appear on the attached booking form and who will hereinafter be called the LESSOR and LESSEE respectively, recognise that they have sufficient mutual capacity for the execution of this contract, and freely and spontaneously affirm:

·          That the company Creuers Costa Nord S.L. is the owner of the kayaks and paddle surf boards offered for rent as well as all the material related to the activity.

·          That having agreed to rent such material with the aforementioned lessee, they formalise their agreement by granting this contract which will be governed by the following clauses:

1st       The lessee shall pay the corresponding amount on delivery of the rented material according to the price list. The material (boards and/or kayak, paddles, and extra material requested) must be returned at the agreed return time at the latest. The late return of the equipment will result in the payment of the corresponding rental fee.

2nd   The lessee acknowledges that the rented equipment is fully operational and undertakes to return the boards and/or kayaks in the same condition, as well as to use them in accordance with the basic rules of navigation and the characteristics of the equipment itself. The lessee shall not use the equipment under the influence of alcohol, narcotics or other substances that may alter his faculties.

3rd    By signing this contract, the lessee is aware of and accepts the conditions of the contract and accepts responsibility for all damages and faults that may be caused by the use of the rented material, both by the lessee and by third parties under his authorisation, as well as the destruction or loss of any of the parts. It shall be the lessee's responsibility to take appropriate security measures to prevent theft or loss. In case of theft, loss, destruction or damage, etc., the lessee will have to pay for the affected object (value 700€ for the paddle surf board and/or kayak, 50€ for the paddle and 30€ for the life jacket). Likewise, any infractions related to the use of the equipment will be the responsibility of the lessee.

4th    The lessor is exempt from any damage(s) and harm(s) that the lessee causes to third parties or to himself/herself. The person signing the rental contract must be over 18 years old and is responsible for the equipment hired.

5th    Both parties submit to the jurisdiction and competence of the Courts and Tribunals of Ciutadella de Menorca for the resolution of any issues that may arise from this Contract, waiving any other jurisdiction that may correspond to them.

The lessee expressly declares that he/she has read, understood and accepts all the general rental conditions described here and on the attached booking page, as well as that he/she is aware of the general and local maritime regulations in force.

Data Protection Policy: In compliance with Organic Law 15/1999 on Personal Data Protection, we inform the client of the existence of a personal data file created by Creuers Costa Nord S.L. for the purpose of maintaining commercial relations, undertaking not to pass them on to any other entity.
